Arrested for 2nd Offense OUI by Middleboro MA Police

Criminal Charges:

Man Arrested by Middleboro State Police and charged in Wareham District Court, Wareham, Massachusetts for Marked Lanes Violation; Operating a Motor Vehicle with License Suspended; OUI-Drugs, 2nd Offense; and Negligent Operation of a Motor Vehicle.

Case Overview:

Massachusetts State Police conducted a motor vehicle stop of an erratic vehicle on the highway. Officers approached the vehicle and observed the male operator to be under the influence of drugs.  The man’s eyes were dilated, he was speaking fast, visibly sweating, and confused.  Officers arrested and transported him back to the barracks.  Once at the barracks, the man was asked to perform several field sobrieties tests, all of which he failed.  The man was then charged with Marked Lanes Violation; Operating a Motor Vehicle with License Suspended; and, OUI-Drugs, 2nd Offense.  The man retained Massachusetts OUI Defense Lawyer, John L. Calcagni III, to defend him in this matter.

Case Result:

Six (6) months at the House of Corrections, all to be suspended for one (1) year with probation. Attorney John L. Calcagni III entered his appearance and immediately secured the man’s release on $2,000 cash bail with the conditions.  Attorney John L. Calcagni III then began to review the evidence and attended several pretrial conferences on the matter.  Attorney John L. Calcagni III successfully brokered an agreement that in exchange for the man’s guilty plea to Negligent Operation of a Motor Vehicle, all other charges were to be dismissed.  The man accepted the disposition and was sentenced to six months at the House of Corrections, all to be suspended for one (1) year with probation.
