Case Overview:

A woman locked herself in her bedroom and called 911 following a physical altercation with her husband.  Police arrived and discovered the husband sitting in the kitchen drinking a scotch.  When they asked him what happened, the man told police “we got into it” and that he “shoved her.”  When police asked where his wife was located, the husband replied, “I think she is in the bedroom and probably because I roughed her up.”  Police noticed that the husband’s eyes were bloodshot and glassy.  He also admitted that he had been drinking.  When police spoke with the woman, she was crying and exclaimed, “Don’t leave me here with him!”  She then informed police that her husband has an extremely bad temper and attacks her frequently for no reason, and that today was one of those times.  She confirmed that her husband had just pushed her and struck her in the arm and the head with his hand.  She also stated that their abusive relationship had been going on for some time. She also told police that husband said, “if you ever call police, I’ll hit you so hard you won’t know what happened.”  The husband was arrest for domestic assault and battery.  The husband contacted Massachusetts Assault and Battery Defense Attorney, John L. Attorney Calcagni and his team immediately began their investigation into the matter.  They contacted the wife and obtained a signed affidavit from her that she did not want to press charges against her husband.  Attorney Calcagni and his team then obtained and reviewed all the evidence in the case, and armed with this affidavit, engaged the Commonwealth in pretrial negotiations.  The Commonwealth represented it would proceed a trial on the man’s admissions and the 911 call recording, even if the wife remained uncooperative.  However, following relentless negotiations, Attorney Calcagni’s team successfully secured the Commonwealth’s agreement to place the man on pretrial probation for 9 months with the condition that he does not abuse his wife.  Assuming he is not charged with a new offense during his period, the matter will be dismissed.
