Criminal Charge:
Man charged in the Attleboro District Court, Bristol County, for:
- Assault and Battery, in violation of M.G.L. c. 265, § 13A(a)
Case Overview:
Police were dispatched to an Attleboro, MA residence for a report of people fighting in the driveway. Upon arrival, police spoke to a man, who stated he was there to receive a check from his employer. When his employer did not give him the full amount of money that he was owed, they began to yell, and the employer punched him in the face. Police did not notice any marks on the man’s face, but they did detect a strong odor of alcohol coming from the man’s breath and his toe bleeding. Upon further investigation, police learned there was another employee, who was no longer on scene, that was also involved in the altercation. When police asked the man about the other missing employee, he claimed the employer punched him in the face too. The employer told police that he was jumped by both men who punched him in the head and face repeatedly following an argument over their pay. The employer, who had visible injuries, also showed police numerous text messages he received from employees threatening to come to his house to cause him harm. This prompted police to arrest the employee on scene and charge him with Assault and Battery in Attleboro District Court. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in his case.
Case Result: Six Months of Pretrial Probation.
Following pretrial negotiations with the Commonwealth, Attorney Calcagni and his team successfully secured the Court’s and Commonwealth’s agreement to place the man on pretrial probation for six (6) months. Pretrial probation does not require an admission of guilt or criminal responsibility and does not qualify as a criminal conviction. Assuming the man remains out of trouble the six (6) months pretrial probation period, his case will be dismissed and eligible to be sealed.
