Criminal Charges:
Woman charged in the Wareham District Court, Plymouth County, Massachusetts for:
- 1 Count of Larceny Under $1200 By Single Scheme, in violation of M.G.L. c. 266, § 30 (1)
- 21 Counts of Uttering a False Check, in violation of M.G.L. c. 267, § 5
- 117 Counts of Credit Card Fraud Under $1200, in violation of M.G.L. c. 266, § 37B (g)
Case Overview:
A male party walked into the police station and reported that his 70-year-old, blind, and handicapped, sister was being taken advantage of by her caregiver. The brother discovered that the caregiver, who assisted with paying the woman’s bills, had access to her financial accounts and was using his sister’s Amazon, QVC, and Walmart accounts to make personal purchases. Police reviewed the woman’s financial records, which indicated that $15,875 was stolen via fraudulent checks and $8,599 was stolen via fraudulent credit card use, totaling a loss of $24,474. In response, police criminally charged the caregiver with 139 counts of theft-related offenses. She retained the Massachusetts Criminal Defense Firm, the Law Office of John L. Calcagni III, to represent her in this case.
Case Result: 18-Month Continuation Without a Finding.
After reviewing and analyzing the evidence, Attorney Calcagni and his team engaged the District Attorney’s Office in lengthy negotiations in an effort to resolve this case, short of trial. Over time, Attorney Calcagni and his team secured a resolution that called for the dismissal of most of the charges. As for the remaining charges, they were resolved with an 18-month continuation without a finding, $10,000 in restitution, 100 hours of community service, and a written apology letter to the victim. After the passage of 18 months, providing the caregiver is not charged with a new offense and satisfies all of the imposed conditions, this case will be dismissed and eligible to sealed from public record.
