Case Overview:
A man, who was going through a contentious divorce, had an open criminal case for Violation of an Abuse Prevention Order, and while on probation for Operating Under the Influence of Liquor (OUI), was charged with Vandalizing Property. This new charge triggered bail and probation violations. The man’s soon to be ex-wife, who had an active restraining order against him, walked into the Attleboro police station to report that while at their son’s little league baseball game, he spit on the passenger side window of her car. She further informed police she felt as if the man was trying to intimidate her. The man received a summons to appear in the Attleboro District Court for an arraignment for Vandalizing Property and the resulting violations. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in these matters.
Case Result:
After reviewing the initial evidence in the man’s case, conducting a legal analysis of the elements related to this new offense, and negotiations with the prosecution, Attorney Calcagni and his team successfully persuaded the prosecution to dismiss the Vandalizing Property case prior to arraignment, which eliminated the related bail and probation violations. The Court also ordered termination of the man’s probation.
