Case Overview:
A man was charged in Taunton District Court with Operating under the Influence (OUI) of Liquor, 2nd Offense in violation of M.G.L. c. 90, § 24(1)(a)(1). Police performed a motor vehicle stop of a man who was driving home from his brother’s house where they watched the Patriot’s NFC championship game and consumed several beers. Police initiated the traffic stop when officers noticed the vehicle stopped in the middle of the roadway with both doors open. The man and his female passenger had an apparent argument. Upon approaching the male operator, police identified a strong odor of alcoholic beverage coming from him. He also admitted to police that he had been drinking. The man also dropped several items on his lap when retrieving his registration and stumbled when exiting the car. Once outside of the vehicle, police noticed that the man’s eyes were bloodshot and watery, and his speech was slurred. He also submitted to and failed a series of field sobriety tests. His preliminary breath test results yielded a Blood Alcohol Content (BAC) of .182%. Once at the station, the man refused to take the breathalyzer test, which resulted in administrative two-year license suspension since this was his second offense. Case Result:
After trial, the man was found not guilty. However, his license remained suspended indefinitely per the order of the RMV. Attorney Calcagni’s team appealed this decision before the Commonwealth of Massachusetts Division of Insurance Board of Appeal. Once before the Board, the members considered a written submission and oral argument in support of reinstating the man’s license. The Board ultimately voted for a full reinstatement, as advocated for by the motorist and his legal team.
