Charged with Threat to Commit a Crime in Taunton District Court

Threat to Commit a Crime in violation of M.G.L. c. 275, § 2

Case Overview:

Seekonk Police (hereinafter “police”) were dispatched to a Home Depot parking lot for the report of a road rage incident.  A woman called 911 stating that a dark vehicle came into the parking lot at a high rate of speed cutting through multiple parking spaces.  The vehicle then cut her off prompting her to slam on her brakes to avoid a collision.  A man then emerged from the vehicle, began yelling profanities, approached her vehicle, and punched the back-driver side window.  The man then threatened to punch the woman in the face and told her he was going to shoot her if she called the police.  The frightened woman photographed the man’s license plate as he further threatened that he knew someone employed by the Registry of Motor Vehicles (RMV), would obtain her address, and visit her home to shoot her and her family.  The man then entered his vehicle and sped away.  After police responded and interviewed the woman, they positively identified the threatening man through his vehicle registration.  Police then criminally charged him in Taunton District Court with Threat to Commit a Crime.  The man, with a criminal history and on bail in another case in Rhode Island, hired Massachusetts criminal lawyer, John L. Calcagni III, to defend him in this matter.

Case Result:

Dismissed. Attorney John L. Calcagni, III successfully secured the man’s release on bail and within six (6) months, successfully filed a motion with the Court, over the Commonwealth’s objection, to dismiss this case for lack of prosecution.
