Criminal Complaint for One Count of Assault and Battery in Fall River District Court

Case Overview:

Fall River Police were dispatched to a three story residence for the report of a fight.  Upon arrival, police spoke to a female occupant who lived on the third floor.  The female informed police that an argument erupted between her and a woman who lives on the second floor.  The argument was over intimate relations that one woman was allegedly having with the other woman’s cousin.  The male cousin was the owner of the residence and lived on the first floor with his wife.  The complaining female told police that while she was standing on the first floor landing, the other woman approached and struck her in the face.  Police noticed a red mark on the side of the woman’s face, which corroborated her complaint.  The other woman admitted to approaching the complainant to tell her to stop spreading rumors about her.  She alleged that complaining female then pushed her backwards causing her to fall and bang her head on the floor.  The woman also admitting to striking the complainant in the face.  Due to this evidence, Fall River Police filed an application for criminal complaint against both women in Fall River District Court seeking charges of Assault and Battery.  One of the women contacted the Law Office of John L. Calcagni, III  to defend her against the application for criminal complaint at a Clerk-Magistrate’s hearing. Following a hearing on this matter, the Clerk-Magistrate denied the police application.
