Case Overview:

Police were dispatched to Home Depot for the report of several thefts from the store involving one of its employees.  Upon arrival, police spoke to the Asset Protection Manager who informed them that an employee, on three separate occasions, assisted in giving away free merchandise totaling approximately $5,000.  The scheme involved the employee scanning items at the register, voiding the purchases, and giving the items to her friends who posed as store customers.  The manager provided police with video surveillance and still photos showing the two friends accept the items and place them in their vehicle right after the employee rang them in and voided them out.  Police identified the individuals by the license plate of their vehicle and the credit card used to facilitate the purchases.  Police then spoke to the employee, who after being read her Miranda rights, admitted her involvement in the crimes.  The employee was charged with several theft-related offenses and conspiracy in Taunton District Court.  She retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend her in her case.  

Case Result: Dismissed.

After reviewing all the evidence, and ongoing negotiations with the Commonwealth, Attorney Calcagni and his associate, Attorney John Pensa, successfully secured dismissal of all charges.
