DNA Sample Failure and Probation Violation in Taunton MA

Case Overview:

A man with a lengthy criminal history pled guilty in Taunton District Court to multiple motor vehicle, larceny, and violent offenses.  The Court sentenced him to one (1) year to serve at the House of Corrections followed by two (2) years of probation, with conditions.  Once released, he failed to report to the Probation Department and submit a DNA sample to the Commonwealth of Massachusetts as required by law, which resulted in him being charged with the additional crime of Failure to Provide a DNA Database Sample.  While a related warrant for this charge was pending, the man was convicted of manslaughter in Rhode Island and sentenced to 25 years in the ACI with 10 years to serve and with the balance of 15 to be suspended with probation.  While serving this sentence, the man retained Rhode Island and Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him before the Taunton District Court. 

Case Result: Dismissed and Probation Terminated.

Following ongoing discussions with the District Attorney’s Office, Attorney Calcagni and his team successfully secured the dismissal of this new charge.  They also secured the dismissal of the related probation violation, which was filed soon after the new charge of failing to provide the DNA sample.  The Court ordered that probation be terminated, and both matters were closed.
