Criminal Charges:
Woman charged in the New Bedford District Court, New Bedford, Massachusetts, for:
- Assault and Battery with a Dangerous Weapon, in violation of M.G.L. c. 265, § 15A(b)
- Assault and Battery on a Family / Household Member, in violation of M.G.L. c. 265, § 13M(a)
Case Overview:
Police were dispatched to an apartment for the report of a domestic incident between a girlfriend and boyfriend. The boyfriend called 9-1-1 and stated that his girlfriend threw glass in his face, and he was bleeding. Police arrived at the apartment, discovered the girlfriend had left, and found the boyfriend sitting on the couch with blood dripping from his face due to lacerations on his nose and under his eye. The boyfriend informed the police that they were both drinking. When an argument ensued, he knocked her wine glass off the table causing it to shatter. She swept the broken glass up into a dustpan and then threw it into his face. The boyfriend was transported to the hospital for his injuries. The girlfriend then received a summons to appear for an arraignment in New Bedford District Court on the charges of Assault and Battery with a Dangerous Weapon (felony) and Assault and Battery on a Family / Household Member (misdemeanor). She retained the Massachusetts Criminal Defense Law Office of John L. Calcagni III, Inc. to represent her in this case.
Case Result: Pretrial Probation.
Following ongoing negotiations with the Commonwealth, and the presentation of mitigation materials on the girl’s behalf, Attorney Calcagni and his team successfully persuaded the prosecution to place the client on pretrial probation with the condition that she complete a 12-hour online anger management course and not abuse her boyfriend. She agreed to accept this favorable offer, which the Court approved. One year from now, assuming the girl remains out of trouble and completes this 12-hour course, her case will be dismissed and be eligible to be sealed from public record.
