Man from Douglas, MA was summoned in the Worcester County Uxbridge District Court for:
- Unlawful Possession of a Large Capacity Feeding Device – M.G.L c. 140, § 131M
Case Overview:
Police were dispatched to a man’s residence following a road rage incident where he was alleged to have stepped out of his car and flashed a firearm at another driver. The man, who possessed a valid license to carry firearms, received notice from police suspending this license. Police responded to the man’s residence to seize his firearm and ammunition. Upon arrival, the man invited police into his upstairs bedroom, provided them with the combination to his safe and allowed them to seize his firearm and three magazines. Upon closely examining the magazines, it was discovered that two out of the three could hold up to 16 rounds, which are deemed large capacity feeding devices under Massachusetts law, and therefore, illegal to possess. Massachusetts law limits firearm magazine capacity to 10 rounds. Based on this discovery, police filed an application for criminal complaint against the man alleging two counts of Unlawful Possession of a Large Capacity Feeding Device. The man received a summons to appear for a Clerk-Magistrate’s hearing in Uxbridge District Court and retained the Law Office of John L. Calcagni III, Inc. to represent him.
