Case Overview:

A man was stopped by police for driving while using a cell phone.  Once at the driver’s side door, police observed in plain view two boxes of ammunition on the front passenger seat floorboard.  Police ordered the man out of the car and searched its contents.  They located a loaded, large capacity, black Glock 20 10 mm handgun under the driver’s seat containing a 15-round magazine.  In the driver’s side door panel, they also found multiple, loaded large capacity magazines and a bag of extra ammunition.  Inside the trunk, police located a black Phoenix Arms .22 caliber handgun, multiple large capacity magazines, 50 grams of cocaine, and $1,882 in U.S. currency.  Based on these discoveries, the man was arrested and charged with multiple felony firearm and drug trafficking offenses.  His family retained Massachusetts Criminal Defense Lawyer, John L. Case Result: 2 Years Probation.

After securing the man’s release on bail following a dangerousness hearing in New Bedford District Court, Attorney Calcagni and his team turned to defending the man in Bristol County Superior Court.  After analyzing all the evidence and litigating several motions, Calcagni and his team submitted a lengthy mitigation submission for the prosecution to consider in support of a non-jail resolution of this case.  After presenting the same submission to the judge, and further negotiating with prosecutors, the man was sentenced to serve 2 years of probation.
