Larceny Charges Resolved in Fall River MA

Man charged in the Fall River District Court, Bristol County, Massachusetts for:

Case Overview:

Police received a call from the superintendent of a school claiming that one of its maintenance employees was stealing tools.  The theft became known after the Director of Maintenance noticed that some tools were missing.  When she confronted the suspected employee, he admitted to having the tools.  Upon further investigation, the director noticed that there were several recently purchased toolboxes and newer tools that were also missing.  Police reviewed the school’s video surveillance, which revealed the employee covering up items with a sweatshirt on numerous occasions during overtime hours, and suspiciously exiting the building and placing items into his personal vehicle.  Police spoke to the employee, who agreed without counsel to waive his Miranda rights, and to voluntarily submit to an audio/video recorded interview with police.  During this interview and admitted to taking the tools from the school.  As a result, he was charged in Fall River District Court with Larceny Under $1,200 and Larceny from a Building (felony).  He retained Massachusetts White Collar Crimes Defense Lawyer, John L. Calcagni III, to defend him in his case.  

Case Result: Six (6) Month Continuation Without a Finding.

Following pretrial negotiations and submission of a mitigation packet prepared on the man’s behalf, Attorney Calcagni and his team persuaded the Court to continue this matter without a finding (CWOF) for six (6) months.  The man also voluntarily returned the missing tools.  Providing he remains trouble free for the CWOF period, the case will be dismissed and eligible to be sealed from public record at the end.
