Man charged in the Bristol County; Attleboro District Court for:
- Malicious Destruction of Property Over $1,200 – M.G.L. c. 266, § 127
Case Overview:
Police were dispatched to the Mansfield MBTA station for a report of fire damage to one of its payment kiosks. Police reviewed the video surveillance at the MBTA station, and observed a man park and exit his vehicle, look around suspiciously, put paper into the receipt tray, light a cigarette, hold something up to the kiosk, and step back and watch the kiosk become ablaze. Police identified the man by the license plate on his vehicle and went to his residence to inquire further. Surprisingly, the man admitted to police that he lit the paper in the receipt tray with his cigarette and purchased a small butane lighter which he used to fuel the fire. The fire rendered the kiosk inoperable with over $15,000 in damages. The man was charged in Attleboro District Court with Malicious Destruction of Property of $1,200 (felony). Case Result: Six (6) Month Continuation Without a Finding (CWOF).
Following ongoing negotiations with the prosecution and after submitting a lengthy mitigation packet for the Court’s consideration, Attorney Calcagni and his team successfully secured a pretrial agreement to continue this matter without a finding for a period of six (6) months with the conditions that the man stay away from the MBTA property in Mansfield, undergo a mental health evaluation and any recommended treatment, and pay restitution in the reduced amount of $5,000. Once before the Court, the judge adopted this agreed upon recommendation and sentenced the man accordingly.
