Criminal Charges:
Man charged via criminal complaint in the Bristol County New Bedford District Court for:
- Indecent Assault and Battery on a Child under 14 – M.G.L. c. 265, § 13B
Case Overview:
A man was charged via criminal complaint in New Bedford District Court with Indecent Assault and Battery on a Child under 14. The case stemmed from allegations by the man’s step- granddaughter who alleged that when she was approximately five or six years old, the man played a game with her where he hid the television remote control in his pants and facilitated her grabbing his penis. She further alleged that the man told her to hold onto his penis. Ten years later at age 15, the girl reported the alleged incidents to police, causing a criminal complaint to issue against the man.
Case Result: Not Guilty After Jury Trial
The man hired Massachusetts Sex Assault Defense Lawyer, John L. Calcagni, to defend him in this matter. Attorney Calcagni and his team obtained and reviewed the evidence in support of the girl’s allegations and subpoenaing several forms of documentation related to her mental health issues. The man maintained his innocence throughout the pendency of his case. While facing possible jail time, sex offender registration and deportation from the United States, elected his right to proceed to trial. Following jury selection, opening statements, examination of a police officer witness, cross examination of the alleged victim, and closing arguments by Attorney Calcagni, the jury returned a unanimous verdict of not guilty.
