Man charged in the Bristol County; New Bedford District Court for:
- Discharging a Firearm within 500 Feet of a Building – M.G.L. c. 269, § 12E
- Possession of a Firearm without a FID Card – M.G.L. c. 269, § 10(h)
Case Overview:
A woman walked into the New Bedford Police Department and reported she was assaulted and beat up by her ex-boyfriend who she had been in an on-and-off relationship with for about three (3) years. The woman informed police that she went to the ex-boyfriend’s house after working a long shift and went to go lay down when he got angry with her and a verbal argument ensued. During the argument, she alleged that the ex-boyfriend slapped her several times in the face, kicked her in her ribs, and knocked her off the bed causing her to strike her side on the floor. The woman provided a picture of a bruise on her side to police and it was submitted as evidence. Shortly thereafter, the ex-boyfriend received a summons in the mail to appear for a Clerk-Magistrate’s hearing in New Bedford District Court for allegations of Assault and Battery on a Family/Household Member, and Assault and Battery with a Dangerous Weapon. The ex-boyfriend contacted the Law Office of John L. Calcagni III, Inc. to represent him at his hearing.
Case Result: Application for Criminal Complaint Denied
Following the Clerk’s remarks, his consideration of a mitigation packet Calcagni’s office submitted on the ex-boyfriend’s behalf, and oral argument by counsel, the Clerk Magistrate found that no probable cause existed on either charge and denied the application for criminal complaint.
