Woman charged in the Attleboro District Court, North Attleboro, Massachusetts, for:
- Negligent Operation of a Motor Vehicle, in violation of M.G.L. c. 90, § 24(2)(a)
Case Overview:
Police were dispatched to a motor vehicle crash at an intersection in North Attleboro, Massachusetts. Upon speaking to the occupants, the police learned that a young woman who had the intention of making a right-hand turn realized late that she was about to miss her turn because she was not paying attention. She then made the turn last second, was unable to do so at the speed she was travelling and cut into oncoming traffic crashing into a motor vehicle that was stopped at a stop sign. The young woman was visibly upset and knew she had caused the crash. Both drivers were transported to the hospital for minor injuries and the police photographed the damage to the vehicles, which were towed from the scene. The woman was charged via criminal complaint in Fall River District Court with Negligent Operation of a Motor Vehicle and retained the Law Office of John L. Calcagni III, Inc. to represent her in her case.
Case Result: Three-Month Continuation Without a Finding (CWOF).
After reviewing and analyzing the evidence, and ongoing negotiations with the Commonwealth, to include showing proof that the damages sought by the victim driver were paid in full by the insurance company, Calcagni’s team successfully secured the Commonwealth’s and Court’s agreement to continue this matter without a finding for a period of three months with the condition that the young woman enter and complete a 4-hour online driver safety course.
