- Larceny Over $1200 – M.G.L. c. 266, § 30 (1)
Case Overview:
Seekonk Police were dispatched to a BJ’s Wholesale Club after the store manager reported that approximately $2,000 worth of merchandise, including three computers and a TV sound bar, were missing and unaccounted for during an inventory check. Police reviewed the surveillance video from the store and discovered a man and his accomplice placing these items into a shopping cart and leaving the store without paying. Unable to identify or apprehend them, police continued their investigation, and that same day, spoke to a security guard at Macy’s who informed them that two men, with matching descriptions, had similarly stolen several pieces of clothing from her store. Police located the men’s vehicle after it left Macy’s and detained the operator. Police compare the video surveillance from both stores and matched the operator. The man, who had a criminal history for theft, fraud, and drug distribution, was ultimately charged with new offenses in one court, and charged with violating his probation in another court. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him.
Case Result: Dismissed.
Attorney Calcagni and his team engaged in ongoing negotiations with the prosecution and successfully secured its agreement to dismiss the man’s case upon the payment of restitution
