Case Overview:

A police officer was on patrol in the parking lot of a Motel 6 in Seekonk, Massachusetts. This area was known to the officer for its criminal activity. As the officer exited the lot, he observed a vehicle occupied by two men bearing a Florida license plate fail to use its directional signal when making a right-hand turn. The officer began to follow the vehicle, observed it swerve into the breakdown lane, and initiated a traffic stop. The vehicle was occupied by two Florida men who were in town visiting. The driver provided the officer with his license and valid registration information. He informed the officer what he was on his way to visit Battleship Cove in Fall River, Massachusetts. The officer noticed the vehicle was filled with blankets, pillows, food wrappers, a cooler and other assorted items. As the driver was reaching around for additional vehicle documentation, the officer asked him if there was anything in the car he should know about. After a slight delay the driver admitted to possessing a gun. The officer removed the men, located, and seized a loaded 9mm pistol. Because the driver did not have a valid License to Carry (LTC) in Massachusetts, he was placed under arrest and charged with Possession of a Firearm without a FID Card, Carrying a Firearm without a License (which carries a mandatory, minimum, day-to-day 18-month jail sentence), Improper Storage of a Firearm, Failure to Signal and Marked Lanes Violation. The driver retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, Inc. to represent him in his case.

Case Result: Dismissed.

The matter was resolved with admission to the violation and the man was continued on the existing terms and conditions of his probation, with no further punishment.
