Case Overview:

A military family member residing on Hanscom Air Force Base was arrested and charged with Possession of Marijuana. Base security officers detected the odor of marijuana coming from the young man’s automobile as he approached the main gate to enter post. This prompted officers to direct the man to pull over for a search and inspection of his vehicle. As a result, they discovered approximately 300 grams of marijuana, which the man claimed was for his own personal use. He was issued a Central Violations Bureau (CVB) Notice of Violation and Summons to appear in United States District Court for the District of Massachusetts. Though marijuana has been legalized, in limited quantities in the Commonwealth, it remains a controlled substance prohibited by federal law. The man retained Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.

Case Result: Dismissed

Attorney Calcagni represented the man’s sister on a similar charge in the past. The siblings lived on post with their parents, one of whom is a retired Air Force Officer and currently, a government contractor. This second incident, attributable to the family as on-post residents, caused a minor stir within the Command. Notwithstanding, Attorney Calcagni was able to successfully negotiate the dismissal of this criminal charge in exchange for the man’s payment of $130 in costs and assessments. He sustained no criminal conviction or adverse criminal history from this disposition and was permitted to continue residing on Hansom Air Force Base.
