Case Overview:

In April 2024, police were dispatched to St. Luke’s Hospital for a verbal altercation between a man and valet parking attendant. The man arrived early to pick up his wife from work, and parked his car in the valet drop off location interfering with the flow of traffic and valet parking service. The man had been told by the attendant several times in the past to not park there. This time, when the parking attendant knocked on the man’s window to get his attention, the man immediately began screaming and yelled to the attendant “the next time you touch my car I’ll kill you!” The man exited the car and continued screaming at the attendant in a belligerent manner and then left the premises. As a result, the attendant called police and the man was charged in New Bedford District Court with Threat to Commit a Crime. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, Inc. to defend him in his case.

Case Result: One Year Continuation Without a Finding (CWOF)

While this case was pending, in November 2024, the man who was in the midst of a divorce, told his wife by text message “I am going to kill you and your family!” Further investigation by police revealed that the man had been continually harassing her, to include, calling her from random numbers when blocked, and sending her abusive emails and pictures to include one of him holding a gun. The man was again charged in New Bedford District Court with Threat to Commit a Crime. He again retained Attorney Calcagni and his office to represent him in this case. After securing the man’s release on bail in this new case, avoiding his bail from being revoked on the first case, Attorney Calcagni and his team engaged in negotiations with the Commonwealth, which culminated with a disposition of the two cases with a one year continuation without a finding (CWOF). In one year, providing the man is not charged with a new offense and abides by any court-imposed conditions, his two cases will be dismissed, and become eligible to be sealed from his Massachusetts criminal record.
