Charged with Drug Possession and Distribution in United States District Court of Massachusetts

Criminal Charges:

Conspiracy to Possess with Intent to Distribute 400 Grams or More of Fentanyl and 500 Grams or More of Cocaine in violation of 21 U.S.C. § 841 (a)(1) and (b)(1)(A).

Case Overview:

Members of the Drug Enforcement Administration (DEA) investigated a large, drug trafficking organization operating in Fall River, Massachusetts.  The investigation consisted of the use of wiretaps, confidential sources of information and informants, controlled drug purchases, physical and electronic surveillance, and drug seizures.  As the investigation wrapped up, federal authorities obtained arrest warrants for 14 co-defendants.  The alleged drug supplier to the organization was not apprehended on the morning authorities executed the arrest warrants.  He voluntarily surrendered to authorities later that day with counsel, Federal Criminal Defense Attorney, John L. Calcagni III.  Upon initially appearing before the Court that afternoon, the government moved for the man’s detention without bail.  U.S. Probation also filed a notice of supervised release violation against the man, as he was presently serving on supervised release following his release from incarceration for a prior federal drug conviction.  The man was ordered held without bail.  Attorney John L. Calcagni III then represented the man at two subsequent bail hearings and filed several motions for reconsideration of bail on the client’s behalf.  After extensive litigation on the subject of bail, Attorney John L. Calcagni III successfully persuaded the Court, over the government’s objection, to release his client on $100,000 secured compliance bond, GPS monitoring, home detention, and other conditions.
