Massachusetts Drug Trafficking Lawyer

Under Massachusetts Criminal law, Drug Trafficking may be found under Massachusetts General Laws, Chapter 94C, Sections 32E.  Drug Trafficking is essentially the same as Possession with Intent to Distribute a Controlled Substance.  

The difference with Drug Trafficking is that if the controlled substance in question involved a certain quantity or more, as set forth by Massachusetts law, the crime is referred to as drug trafficking and enhanced penalties apply.  

The legal elements are identical to Possession with Intent to Distribute a Controlled Substance with the added element of the threshold quantity of the alleged drug. 

The punishment under Massachusetts criminal law for Drug Trafficking may be found at Massachusetts General Laws, Chapter 94C, Sections 32E.  The potential punishment varies by the class and quantity of drug trafficked.

Trafficking Marijuana

50 pounds or more of Marijuana, but less than 100 pounds

Anyone who knowingly or intentionally manufactures, distributes, dispenses, or cultivates or possesses with intent to manufacture, distribute, dispense, or cultivate 50 pounds or more, but less than 100 pounds of either marihuana or any mixture containing marihuana shall be punished by a term of state prison for not less than 2 ½ nor more than 15 years or by a term in the house of corrections for not less than 1 nor more than 2 ½ years and a fine range of $500 to $10,000. 

100 pounds or more of Marijuana, but less than 2,000 pounds

If the quantity involved 100 pounds or more, but less than 2,000 pounds, the defendant shall be punished by a term in state prison of not less than 2 years nor more than 15 years and/or a fine range of $2,500 to $25,000. 

2,000 pounds or more of Marijuana, but less than 10,000 pounds

If the quantity involved 2,000 pounds or more, but less than 10,000 pounds, the defendant shall be punished by a term in state prison of not less than 3 ½ nor more than 15 years and/or a fine range of $5,000 to $50,000. 

If the quantity involved 10,000 pounds or more, the defendant shall be punished by a term in state prison of not less than 8 years nor more than 15 years and/or a fine range of $20,5000 to $200,000.

Trafficking Cocaine

Anyone who knowingly intentionally manufactures, distributes or dispenses or possesses with intent to manufacture, distribute or dispense a net weight of 18 grams or more, but less than 36 grams of cocaine or any mixture containing cocaine shall be punished a term in state prison for not less than 2 years nor more than 15 years and/or a fine ranging from $2,500 to $25,000. 

36 grams or more of Cocaine, but less than 100 grams

If the quantity of cocaine involved 36 grams or more, but less than 100 grams, the defendant shall be punished by a term in state prison for not less than 3 ½ years nor more than 20 years and/or a fine ranging from $5,000 to $50,000. 

100 grams or more of Cocaine, but less than 200 grams

If the quantity of cocaine involved 100 grams or more, but less than 200 grams, the defendant shall be punished by a term in state prison for not less than 8 years nor more than 20 years and/or a fine ranging from $10,000 to $100,000.  

200 grams or more of Cocaine

If the quantity of cocaine involved 200 grams or more, the defendant shall be punished by a term in state prison for not less than 12 years nor more than 20 years and/or a fine ranging from $50,000 to $500,000.

Trafficking Heroin

18 grams or more of heroin, but less than 36 grams

Anyone who knowingly intentionally manufactures, distributes or dispenses or possesses with intent to manufacture, distribute or dispense a net weight of 18 grams or more, but less than 36 grams of heroin, morphine or any salt thereof, opium or any derivative there, or any mixture containing any of these substances shall be punished a term in state prison for not less than 3 ½ years nor more than 30 years and/or a fine ranging from $5,000 to $50,000. 

36 grams or more of heroin, but less than 100 grams

If the quantity of heroin (or other drug named in this paragraph) involved 36 grams or more, but less than 100 grams, the defendant shall be punished by a term in state prison for not less than 5 years nor more than 30 years and/or a fine ranging from $5,000 to $50,000. 

100 grams or more of heroin, but less than 200 grams

If the quantity of heroin (or other drug named in this paragraph) involved 100 grams or more, but less than 200 grams, the defendant shall be punished by a term in state prison for not less than 8 years nor more than 30 years and/or a fine ranging from $10,000 to $100,000. 

200 grams or more of heroin

If the quantity of heroin (or other drug named in this paragraph) involved 200 grams or more, the defendant shall be punished by a term in state prison for not less than 12 years nor more than 30 years and/or a fine ranging from $50,000 to $500,000.

Trafficking Fentanyl

Anyone who knowingly or intentionally manufactures, distributes, dispenses or possesses with intent to manufacture, distribute or dispense a net weight of 10 grams or more of fentanyl, any derivative of fentanyl, or more of any mixture containing this substance, shall be punished by a term in state prison for not less than 3 ½ nor more than 20 years.

Trafficking Carfentanil

Anyone who knowingly or intentionally manufactures, distributes, dispenses or possesses with intent to manufacture, distribute or dispense a net weight of 10 grams or more of carfentanil, any derivative of carfentanil, or more of any mixture containing this substance, shall be punished by a term in state prison for not less than 3 ½ nor more than 20 years.
