Criminal Charges:
Man charged in the Fall River District Court, Bristol County, for:
- Assault and Battery on a Family/Household Member, in violation of M.G.L. c. 265, § 13M(a)
- Assault and Battery with a Dangerous Weapon, in violation of M.G.L. c. 265, § 15A(b)
- Assault and Battery on a Family/Household Member, in violation of M.G.L. c. 265, § 13M(a)
Case Overview:
An existing client who was previously charged with Assault and Battery on a Family/Household Member, picked up two new cases that involved the same girlfriend. The man again retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in these new matters in Fall River District Court.
Case Result: Dismissed.
This time around, the girlfriend alleged the man hit her in the face and threw her to the floor, resulting in him being charged with Assault and Battery on a Family/Household Member. Approximately one month later, she alleged that he slammed her against the floor several times resulting in him being charged again with Assault and Battery with a Dangerous Weapon and Assault and Battery on a Family/Household Member. A condition of the man’s existing bail in his other open cases was to stay away and have no contact with his girlfriend. The man apparently failed to abide by this condition, prompting the Commonwealth to file a motion to revoke his bail based on both him violating his bail conditions and being charged with new offenses. Attorney Calcagni and his team successfully opposed the Commonwealth’s motion to revoke his bail. Later in the case, Attorney Calcagni and his team persuaded the prosecution to dismiss the pending domestic violence cases.
