Case Overview:
Auburn Police arrested a woman for her role in a joint venture with two other females to commit larceny from a TJ Maxx Department Store. The three women entered TJ Maxx pretending to be customers. A store representative notified police that three females were seen using a commercial retail magnet to remove security tags from merchandise and concealing the merchandise inside large bags. The store employee also observed one of the females exit the store without paying and enter a vehicle located in the store’s parking lot. Upon arrival, police located the suspected vehicle and discovered a woman in possession of several stolen retail items inside. The woman was subsequently arrested and charged in Worcester District Court with Larceny Over $1,200; Unlawful Possession of Theft Detection Device Deactivator or Remover; and, Conspiracy to Commit Larceny. The woman retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend her in this matter.
Case Result:
Dismissal upon completion of pretrial probation for one year. Attorney John L. Calcagni III reviewed the discovery and then put together an extensive mitigation submission for the Commonwealth to consider. Because the woman was not a U.S. Citizen, a dismissal was her only way to avoid deportation back to Guatemala. She was also married, had young children, and no criminal record. Calcagni III persuaded prosecutors to allow the woman to serve one year of pretrial probation with conditions that she stay away from all TJ Maxx stores in Massachusetts and pay $4,014.85 in restitution. Once the pretrial probationary period ends, so long as the restitution is paid and the woman is not charged with a new offense, the matter will be dismissed and eligible to be sealed from her record. She will not incur a felony conviction from this disposition or suffer any adverse immigration consequences.
