Man summoned in the Plymouth County Plymouth District Court for failure to stop or yield in violation of M.G.L. c. 89, § 9.
Case Overview:
A man was summoned to appear for a Clerk Magistrate’s Hearing in Plymouth District Court for failing to stop or yield at a stop sign. While approaching a stop sign near his home, a police officer parked nearby witnessed him roll through the sign, executed a motor vehicle stop, and cited the man for the observed violation. The man originally appeared on his own without a lawyer for a hearing related to the citations and persuaded the Clerk-Magistrate to hold his matter open for six months, as long as the man did not commit any other offenses during that time. If he lived up to his end of the bargain, the matter would be dismissed. A few months later, the man was stopped again by law police and this time, received a citation for speeding. The Plymouth District Court Clerk’s Office was notified of the speeding violation, prompting a summons for the man to reappear to readdress the prior stop sign violation.
The man, with several moving violations on his driving record, and in fear of losing his license, contacted and retained the Law Office of John L. Calcagni III, Inc. to represent him at his hearing.
