Criminal Charges:
A woman charged in Bristol County in the Fall River District Court for:
- Unarmed Robbery in violation of M.G.L. c. 265, § 19(b)
- Assault and Battery in violation of M.G.L. c. 265, § 13A(a)
Case Overview:
Police were dispatched to a Walmart Superstore in Fall River, Massachusetts for the report of a robbery. Police arrived and spoke to the female victim who informed them that she was just jumped and that some of her property was taken by her assailants. The victim identified her assailants, a male and a female, from her prior friendship with them. All three had a verbal altercation inside the store. When the victim walked out to her car, the female assailant ran up to her and began striking her with her fists and pulling her hair. The male party then joined in, ripping the victim’s shirt and breaking her necklace. The contents of the victim’s purse fell to the ground during the attack. The assailants picked up these items fled from the scene. Police observed scratches and red marks on the face and body of the victim and a handful of hair that had been pulled out of her head, all of which were noted in their report. Walmart also provided police with video footage of the incident from its surveillance system. Based on the evidence, a warrant issued for both parties, remained outstanding for months. The female was eventually picked up on the warrant in Rhode Island and transported to Massachusetts to face the charges. She hired Massachusetts Attorney, John L. Calcagni III, and his team to work on her case.
Case Result:
After securing the female’s release on her personal recognizance, Attorney Calcagni’s team appeared on the woman’s behalf for several pretrial conferences. Following ongoing negotiations with the Commonwealth, Attorney Calcagni’s team successfully secured the prosecution’s agreement to continue the woman’s case without a finding for six months with the conditions that she pay restitution and have no contact with the victim. At the conclusion of this time period, the matter will be dismissed and eligible to be sealed.
