Criminal Charges:
Man charged in the New Bedford District Court for:
- Two (2) Counts of Indecent Assault and Battery on a Child Under 14 – M.G.L. c. 265, § 13B
Case Overview:
A seventy-eight year-old man was charged in New Bedford District Court with two counts of Indecent Assault and Battery (i.e. sexual assault) on his great granddaughter. The great granddaughter, who was twenty-five years-old at the time she reported the allegations to police, stated that when she was eight years-old, her great grandfather came up behind her, touched her on her buttocks and vagina over her clothes, put his hands inside of her pants, inserted his fingers into her vagina, gave her money, and told her not to say anything. She also alleged that when she was thirteen years-old, he groped her breast and buttocks over her clothes when she tried to hug him at a family cookout. She further informed police that recently, she witnessed him grab her younger sister’s breasts and buttocks over her clothes, which prompted her to finally make these disclosures. The man retained Massachusetts Sexual Assault Defense Lawyer, John L. Calcagni III, to represent him in his case.
Case Result: Dismissed.
Attorney Calcagni and his team conducted an extensive investigation into the allegations, which revealed several inconsistencies in the alleged victim’s statements to police. Armed with this information, Attorney Calcagni and his team engaged in ongoing negotiations with the prosecution in an effort to secure the dismissal of the case. This matter was ultimately scheduled for jury trial. On the day of trial, the prosecution informed the Court that it was unable prove its case. In response, Attorney Calcagni and his team successfully motioned the Court to dismiss all charges.
