Criminal Charges:
Man arrested in Dracut, MA and charged in the Bristol County; Taunton District Court for:
- Distribution of a Class E Drug (to wit: Alprazolam) – M.G.L. c. 94C, § 32D(a)
- Amended to: Possession to Distribute a Class E Drug – M.G.L. c. 94C, § 32D(a)
Case Overview:
Homeland Security Investigations notified Dracut Police of a delivery of Alprazolam inside a mail package that was seized by U.S. Customs and Border Protection as coming from the United Kingdom. The name and address of the man receiving this delivery was listed on the package. Police investigated the address, discovered the man’s name on the mailbox and confirmed that he lived there. Police obtained a search warrant to enter the man’s home to seize the package once it was delivered. The package contained approximately 30 grams of Alprazolam in pill form. The recipient agreed to speak with police, explained to the process he underwent to obtain the pills from the dark web and voluntarily consented to a search of his laptop. The man was arrested and charged in the Lowell District Court with the Distribution of a Class E Drug. He hired Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in his case.
Case Result: Six (6) Month Continuation Without a Finding (CWOF).
Following several conferences and hearings before the Court, and ongoing negotiations with the District Attorney’s Office, Attorney Calcagni and his team successfully secured the prosecutor’s agreement to amend the charge to Possession to Distribute a Class E Drug and continue the case without a finding for six (6) months with no conditions. Once before the Court, the judge adopted this joint recommendation and sentenced the man accordingly.
