Criminal Charges:
Juvenile charged in the Norfolk County Dedham Juvenile Court for:
- Carrying a Firearm Without a License, in violation of M.G.L. c. 269, § 10(a)
- Possession of a Firearm Without a FID Card, in violation of M.G.L. c. 269, § 10(h)
- Possession of Ammunition Without a FID Card, in violation of M.G.L. c. 269, § 10(h)(1)
- Carrying a Loaded Firearm Without a License, in violation of M.G.L. c. 269, § 10(n)
- Unlicensed Operation of a Motor Vehicle, in violation of M.G.L. c. 90, § 10
- Motor Vehicle Lights Violation, in violation of M.G.L. c. 90, § 7
Case Overview:
A police officer monitoring traffic at night noticed a vehicle operating with only its parking lights activated. The officer stopped the vehicle and discovered five occupants inside who began to frantically look around, lean over, and reach down to their feet. While the juvenile driver was looking for his license and registration, the officer noticed the driver lift his sweatshirt over a bag that was consistent with a firearm holster. When the officer inquired about what the driver had just covered up, he stated “nothing.” At the officer’s request, the juvenile lifted his shirt, which revealed the outline of a firearm holster, and was ordered out of the vehicle and searched. When asked where the firearm was, the driver told the officer that he did not have one. All the passengers were ordered to keep their hands up, but became argumentative, began to put their hands down, and refused to listen to the officers’ commands. Other officers arrived on scene and ordered the occupants out of the vehicle to be searched. Police also searched the vehicle and located a fully loaded Smith and Wesson .38 Special pistol tucked between the driver’s seat and the center console. The driver, who was a juvenile at the time and did not have a firearms license, was arrested, and charged with multiple felony firearm offenses and motor vehicle infractions. He retained Massachusetts Criminal Defense Attorney, John L. Calcagni III, to represent him in his case.
Case Result: 6 Months Probation with Conditions.
At arraignment, the Commonwealth moved to hold the juvenile without bail on grounds of dangerous. However, Attorney Calcagni and his team successfully defeated this request, thereby securing the juvenile’s release on cash bail and conditions. Following ongoing negotiations with the Commonwealth, and oral argument by counsel, Attorney Calcagni negotiated to resolve this case with probation.
