Man charged in Woburn District Court, Middlesex County for:
- Assault and Battery Causing Serious Bodily Injury, in violation of M.G.L. c. 265, § 13A(b)
Case Overview:
Stoneham Police responded to an LA Fitness gym for the report of a physical altercation. Upon arrival, police learned that a number of men at the gym were involved in a pick-up game of basketball. The competitive game became contentious when two players exchanged words. During the verbal altercation, one player struck the other in the face one time, breaking the man’s jaw. He then fled the area before police arrived. With the assistance of LA Fitness employees, police were able to identify the man via the gym’s membership records. Police also retrieved a video of the entire altercation. Based on this investigation, police located and charged the man in Woburn District Court with Assault and Battery Causing Serious Bodily Injury. In response, he retained Massachusetts Criminal Defense Lawyers, John L. Calcagni III and Patrick Gioia, to represent him in this matter.
Case Result: Continuation Without a Finding (CWOF) for 12 Months.
The lawyers first appeared with the man for his arraignment and successfully secured his release on bail. Unable to reach a favorable pretrial resolution of the charges, Attorneys Calcagni and Gioia set the case down for trial. On the morning of this event, the Commonwealth agreed to resolve this case with a Continuation Without a Finding CWOF). Providing the man successfully avoids being charged with a new crime for a term of 12 months, the case will be dismissed and eligible to be sealed from the public record.
