Criminal Charges:
Man charged in the Wrentham District Court, Franklin, Massachusetts, Bristol County, for:
- Assault and Battery with a Dangerous Weapon, in violation of M.G.L. c. 265, § 15A (b)
- Witness Intimidation, in violation of M.G.L. c. 268, § 13B
- Distribution of a Class B Drug (cocaine), in violation of M.G.L. c. 94C, § 32A (a)
- Distribution of a Class B Drug (suboxone), in violation of M.G.L. c. 94C, § 32A (a)
Case Overview:
Police were dispatched to a residence following a 9-1-1 hang up. Upon arrival, they were met at the front door by a woman holding an infant child, both of whom were crying and scared. Police entered the residence and noticed broken glass covering the kitchen floor and a cut across the woman’s forehead. Outside of the residence, police spoke to her boyfriend, who admitted that an argument ensued between them. The girlfriend informed police that her boyfriend arrived home intoxicated, verbally degraded her causing an argument to ensue, which culminated with him hitting her, throwing her to the ground, and slamming her head against the floor. She then tried to call 9-1-1 but he hung up and damaged her phone. Police arrested the boyfriend for Assault and Battery with a Dangerous Weapon and Witness Intimidation. Upon searching the boyfriend, police located and seized $24,010, 71 suboxone films, marijuana, cocaine, and two gold chains on his person. The boyfriend gave police permission to search inside his vehicle to where they discovered more cocaine and evidence of drug trafficking. As a result, he was also charged with two counts of Distribution of a Class B Drug (cocaine and suboxone). The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend against these charges.
Case Result: Probation.
Following pretrial negotiations on the man’s behalf, Attorney Calcagni and his team successfully secured the dismissal of the Assault and Battery with a Dangerous Weapon, Witness Intimidation and Distribution of a Class B Drug (suboxone) charges. As for the remaining felony charge of Distribution of a Class B Drug (cocaine), it was reduced or amended to Possession of a Class B Drug (cocaine), a misdemeanor offense, and resolved with one year or probation.
