6-Month CWOF for Breaking Into a Depository Charge

Case Overview:
At approximately 9:00 PM, police received a call from a concerned citizen and were dispatched to a nearby laundromat. The concerned citizen that alleged a man, with a criminal history in both Massachusetts and Rhode Island, was vigorously shaking a coin machine attempting to get steal cash from the machine. Upon arrival, police observed the man continually shaking the machine. They ordered the man to leave the establishment, and awaited the arrival of the business owner. In the interim, police reviewed video footage taken by the concerned citizen, which revealed the man not only shaking the machine, but using a straightened coat hanger to fish inside of it while aggressively attempting to pull out money. The business owner arrived and advised that he would review the security footage and perform a count of the machine to determine if any money was missing. The following day, the business owner confirmed for police that that $50.00 cash was stolen. The man was charged in Worcester District Court with Breaking Into a Depository. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in his case.
Case Result: Continuation Without a Finding (CWOF)
After reviewing and analyzing the evidence, and ongoing negotiations with the Commonwealth, Attorney Calcagni and his team persuaded the Court and Commonwealth to resolve this case with a 6-month continuation without a finding (CWOF) with the condition that the man stay away from and have no contact with the laundromat or its business owner. If the man is not charged with a new offense during the CWOF period and abides by these conditions, his case will be dismissed.
