Sex Trafficking and Prostitution Charges Dismissed in Westfield MA

Case Overview:
Police received several complaints from various individuals in the community related to an Asian massage spa, owned by a husband and wife, which was offering sexual services for a fee. During surveillance of the business by police, it was learned that employees slept overnight at the establishment. After a few weeks, employees would also leave and be replaced by new employees. Police interviewed several men who admitted to receiving sexual services at the spa. Police also interviewed one of the employees who informed them the only money she receives while working were tips from customers following sexual services. The interviewed employee also implicated the owners as having knowledge of these illicit dealings. The husband and wife were arrested and charged with Trafficking of a Person for Sexual Servitude, Deriving Support from Prostitution, and Keeping a House of Prostitution in Westfield District Court. They retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend them.
Case Result: Charges 1 and 2, Dismissed; Charge 3, 6 Month Continuation Without a Finding, with Community Service.
Following negotiations with the Commonwealth, Attorney Calcagni and his team secured the following offer to resolve these cases: Counts (1) and (2), dismissed, resulting in the elimination of otherwise applicable mandatory minimum jail sentences of up to five years and Count (3), 6-month continuation without a finding (CWOF). The Court adopted the parties’ agreed upon resolution, with the added condition of 30-hours of community service.
