Criminal Charges:
Man charged in the United States District Court for the District of Massachusetts for:
- Felon in Possession of Firearms and Ammunition, in violation of 18 U.S.C. § 922(g)(1)
City, State, County and Court:
Boston, Massachusetts, United States District Court for the District of Massachusetts
Case Overview:
New Bedford Police executed a search warrant as part of a fentanyl distribution investigation. Police obtained the warrant after an undercover officer made several controlled drug purchases from the target. At the time of the warrant’s execution, no drugs were discovered. However, the target voluntarily informed police of a storage facility that he maintained and consented to a search of its contents. Inside police discovered and seized three semi-automatic handguns and a large quantity of ammunition. The man was arrested and initially charged in New Bedford District Court based on these illegally possessed items. Over time, federal authorities assumed prosecution of this case via an indictment in United States District Court for the District of Massachsuetts, which charged the man with Felon in Possession of Firearms and Ammunition in violation of 18 U.S.C. § 922 (g)(1). The man retained Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 24 months of imprisonment followed by 1 year of supervised release and a fine.
Attorney Calcagni developed a strategy that called his client’s admission of guilty without the benefit or protection of a written plea agreement. At the time of sentencing, the man’s U.S. Sentencing Guidelines range was 57 – 71 months based on his Offense Level of 21 and Criminal History Category IV. At sentencing, Attorney Calcagni persuaded the Court to impose a below-guidelines sentence of 24 months to serve followed by 1 year of supervised release.
