Case Overview
Police were dispatched to a parking lot for a call regarding a hit and run motor vehicle accident. Upon arrival, police were met by a pedestrian standing next to his heavily damaged vehicle that had been pushed 20-30 feet from its parking space. The pedestrian informed police that when he returned to his vehicle in the lot, it was displaced and damaged but had no idea who caused the damage. Several days later, a woman who witnessed the accident came into the police station and provided a statement to police. She indicated she was a passenger in the motor vehicle that struck the pedestrian’s vehicle, suffered a neck injury during the accident that required medical treatment, and identified the driver. Specifically, she informed police the driver was attempting to flee from an altercation the woman was having with another person, lost control of his vehicle, and hit the pedestrian’s vehicle in the process. Furthermore, when she attempted to convince the driver to report the accident, he refused and stated he would deny any involvement if the woman reported it. Police attempted to contact the driver numerous times, but he refused to return their calls or file an accident report. The driver was summoned to Court for arraignment to answer on the charges of Leaving the Scene of Personal Injury, Negligent Operation of a Motor Vehicle, and Failure to File an Accident Report. He failed to appear and a warrant was issued for his arrest. The man then retained the Law Office of John L. Calcagni to assist him with removing the warrant and his case.
After reviewing and analyzing the evidence, and ongoing negotiations with the Commonwealth, Attorney Calcagni successfully secured the dismissal of all charges.
