Case Overview
Police were dispatched to disturbance. Upon arrival, they met a man who reported that another motorist sideswiped his vehicle when he pulled into the nearby parking lot. The man unsuccessfully tried to exchange paperwork with the motorist who he believed had been drinking. A verbal altercation ensued. When the complaining party told the motorist he was drunk, became upset and wanted to fight. The motorist pushed the man. When the man’s girlfriend intervened, the motorist mushed her in the face. Police spoke to the girlfriend who corroborated these events, along with camera footage from a nearby restaurant. The motorist received a summons in the mail to appear for a Clerk-Magistrate’s Hearing in New Bedford District Court. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, Inc. to defend him against an application for a criminal complaint at a Clerk-Magistrate’s Hearing. New Bedford Police filed the application seeking to charge the man with Assault and Battery. Following the hearing, Attorney Calcagni and his team successfully persuaded the Clerk-Magistrate to deny the application, resulting in no criminal charges.
