Case Overview
Two daughters accused their biological father of sexual molestation. One daughter claimed that when she was 15, her father would rub her breasts and stomach under her clothing and that he would give her an attitude when she pushed him away. His other daughter alleged that he would rub her beasts under her clothing as well. She also claimed he would rub her back and grab her upper thighs when she was in the car or on the couch with him, stretch her underwear out and look under it, and smack her butt. The man was arrested and charged with Indecent Assault and Battery on a Person 14 or Over and Indecent Assault and Battery on a Child Under 14. He retained Massachusetts Criminal Defense Attorney John L. Calcagni III to represent him in his case. After a lengthy discovery process, the man elected his right to proceed with a jury trial. The parties litigated motions in limine, selected a jury, conducted opening statements and direct and cross examination of the daughters, a son, a stepdaughter and wife (the girls’ stepmother). After two devastating cross-examinations of the girls, followed by impeachment testimony from their stepbrother and stepmother, and Attorney Calcagni’s persuasive closing argument, the jury returned not guilty verdicts on all charges.
