Case Overview
A man was arrested and charged with multiple sex offenses involving two separate alleged minor victims, which resulted in police obtaining and executing a search warrant at his home. A search of the residence yielded the discovery of two high-capacity rifle magazines with ammunition (5.56 mm) and an M4 rifle loaded with a full magazine (5.56 mm) inside of an unlocked black case under his bed. There was no properly engaged safety device affixed to the rifle or locking mechanism on the case. The rifle was capable of accepting high-capacity magazine and had both a telescoping stock and pistol grip, which met the requirements of a prohibited assault weapon under Massachusetts criminal law. During an interview with police, the man admitted to building the firearm. Once indicted, he retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him against charges for Possession of an Assault Weapon and Improper Storage of a Large Capacity Firearm in Bristol County Superior Court. After reviewing and analyzing all the evidence, and ongoing discussions with the Commonwealth, Attorney Calcagni and his team negotiated a pretrial, nonjail resolution of this case that resulted in the man’s placement on probation for two years with the condition that he does not possess any firearms without a license or other dangerous weapons.
