Case Overview:

A woman was granted an abuse prevention order against her soon to be ex-husband from whom she was pending divorce. The terms of the abuse prevention order required the man to stay away from his wife’s residence and fifty yards away from her person. One afternoon, the woman observed a motorcycle pass by her residence and rev its engine. The woman identified the motorcyclist as her ex-husband and called police. Officers were able to prove the man was in the vicinity of the woman’s residence using data from the GPS monitoring device he was wearing as a condition of his bail in Bristol County Superior Court. Police responded to the man’s residence, observed a motorcycle in his driveway, and placed him under arrest for violating the abuse prevention order. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him this case before the Taunton District Court.

Case Result: Case Dismissed.

After reviewing and analyzing all the evidence, and conducting legal research on the man’s behalf, Attorney Calcagni and his team filed a motion to dismiss the case.  Upon reviewing the written legal memo submitted in support of the motion and oral argument by the parties, the Court determined there was no probable cause to believe the man committed the offense, thereby allowing the motion and causing this case to be dismissed.
