Man Arrested by Easton Police Department and charged in Taunton District Court, Taunton, Massachusetts for Probation Violation.
Case Overview:
An Easton police officer was on patrol when he decided to conduct a random check of a motor vehicle. The registration was revoked, and owner’s license was suspended. The officer stopped the vehicle and learned the driver was borrowing the car and not its owner. The officer informed the man the car was going to be towed. The man handed over the keys and gathered his belongings from the trunk. While the truck was opened, officers detected a very strong odor of marijuana. They used a flashlight to illuminate inside the trunk and discovered five 1-gallon bags of marijuana. Officers arrested and charged the man with Possession with Intent to Distribute Marijuana in Taunton District Court. The case was eventually resolved, over the prosecution’s objection, with a Continuation Without a Finding (CWOF) for 12 months and a fine of $3,000. During the CWOF period, the man was to remain supervised by probation and if not charged with a new offense, would be entitled to have the case dismissed after the passage of one year. While still serving his CWOF sentence, the man was arrested and charged again, this time in Newburyport District Court, with Operating Under the Influence (OUI) and Negligent Operation of a Motor Vehicle. These charges led to the filing of probation violation in Taunton District Court. The man returned to Massachusetts Criminal Lawyer John L. Calcagni III for representation.
Case Result:
No Punishment. After several court appearances, Attorney John L. Calcagni III and his team miraculously negotiated for no punishment in exchange for an admission to a probation violation. This result allowed the initial CWOF sentence to remain intact, thereby still entitling the man to receive a full dismissal after the passage of 12 month.
