Case Overview:
Police were dispatched to a marijuana dispensary in Seekonk, Massachusetts for the report of a disturbance between two parties. Upon arrival, police spoke to a man who stated he and a female were both reversing their vehicles from respective parking spots which caused them to be in the same lane facing each other. When the female informed the man that he was in the wrong lane, a verbal argument ensued between them, and the woman flicked her lit cigarette at the man, causing a burn mark on his chest. The woman drove off and the man followed her to try and get her to pull over. Eventually, both vehicles parked in an adjacent parking lot at a gas station, 911 was called, and police arrived. The man showed police the burn mark on his chest, and the front seat passenger in his vehicle corroborated his version of the events. The woman received a summons to appear in Taunton District Court to answer on the felony charge of Assault and Battery with a Dangerous Weapon. She retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend her in this case.
Case Result: Six Months Pretrial Probation.
After reviewing and analyzing all the evidence, conducting investigatory efforts on the woman’s behalf, and ongoing negotiations with the District Attorney’s Office, the parties reached an agreement to resolve the case with six months of pretrial probation. This form of disposition is essentially a prolonged dismissal, and not a criminal conviction. It requires no admission of criminal responsibility or guilty plea. After six months, providing the woman remains out of trouble and has no contact with the man, her case will be dismissed and become immediately eligible to be sealed from public record.
