Case Overview:
On the 4th of July, a dispute arose between a man and his neighbor. The man had several guests at his home for the holiday. The neighbor alleged the man and his guests were shooting fireworks at his home. The neighbor further alleged that the fireworks landed on his property, hitting his house. The neighbor and two others went to the man’s house. When the neighbor asked the man to cease his activities, an altercation ensured. The neighbor alleged that he was physically attacked. The man claimed that he acted in self-defense when confronted by the neighbor wielding a baseball bat. The neighbor was arrested and criminally charged. He responded by successfully securing a restraining order against the man, and then a private criminal complaint for Assault and Battery. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in these intertwined cases, one in which he was the victim and another, in which he was the defendant.
Case Result: Dismissed.
