Case Overview:
Federal authorities conducted a long-term investigation into two overlapping drug trafficking organizations operating in the District of Massachusetts and elsewhere. The investigation involved the use of wiretaps, physical surveillance, motor vehicle stops leading to drug seizures, and the execution of dozens of search warrants leading to the seizure of drugs, money and guns. Authorities targeted, among others, the leader of one organization, who had access to three apartments. Police executed warrants at each location, which yielded evidence of the man’s large scale drug distribution business. The man was arrested, charged and indicted in United States District Court for the District of Massachusetts, alongside 13 co-defendants, for Conspiracy and Possession with Intent to Distribute 400 Grams or More of Fentanyl, Heroin, and Cocaine. Once arrested and charged, the man retained former federal prosecutor and Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 84 Months in Prison, Followed By Supervised Release
After reviewing the evidence and assessing the strength of the case, Attorney Calcagni negotiated the terms of a plea agreement with the government. The man faced an advisory U.S. Sentencing Guidelines Range of 168 to 210 months of imprisonment at the time of sentencing. However, Attorney Calcagni persuaded the Court to impose a sentence of 84 months of incarceration, followed by five years of supervised release.
