Breaking and Entering and Vandalism Charges Dismissed in Falmouth Juvenile Court

  • Breaking and Entering a Building in the Nighttime to Commit a Felony, in violation of M.G.L. c. 266, § 16
  • Vandalizing Property, in violation of M.G.L. c. 266, § 126A

Case Overview:

Police were dispatched to a vacant commercial building for a recent break-in and vandalism. Upon arrival, police met with the tenant of the building, who was in the process of renovating it. He informed the police that he was the last one in the building about two weeks ago, and when he left, nothing had been damaged or destroyed. However, when he returned, he observed considerable damage to the property, to include, multiple gallons of paint thrown across the floor, fire extinguishers smashed through the walls, and several destroyed light fixtures. The scene was photographed, and multiple fingerprints were lifted from the fire extinguishers. The case went cold for about four years, until police were able to identify a suspect whose fingerprints were now in the system. The suspect received a summons to appear in Falmouth Juvenile Court to answer criminal charges of Breaking and Entering and Vandalism. He retained Massachusetts Criminal Defense Lawyer, John L. Case Result: Dismissed

Following ongoing negotiations with the Commonwealth, Attorney Calcagni and his team successfully secured the Commonwealth’s agreement to dismiss all charges.
