- Shoplifting by Asportation, in violation of M.G.L. c. 266, § 30A
- Possession of a Class B Drug (crystal meth) , in violation of M.G.L. c. 94C, § 34
Case Overview:
Police were dispatched to a Best Buy in Seekonk, MA for a reported shoplifting. Upon arrival, police noticed a woman matching the description of the suspect exit the store and begin pacing back and forth. Police approached the woman and immediately noticed a large folding knife on her fanny pack around her waist. Officers retrieved the knife, detained the woman, and ordered her to place her purse on the trunk of the police cruiser. Police inspected the pack and located Apple white lightening chargers, consistent with the stolen items. They also located a clear glass pipe consistent with drug paraphernalia. Lastly, they located numerous needles and two bags of crystal methamphetamine. Based upon this discovered evidence, police arrested the woman and charged her in Taunton District Court with Shoplifting by Asportation and Possession of a Class B Drug. The woman failed to appear as directed, causing the issuance of a warrant for her arrest. Months later, she retained Massachusetts Criminal Defense Attorney John L. Calcagni III, to represent her in her case.
Case Result: Dismissed
Attorney Calcagni and his team successfully surrendered the woman before the Court where the warrant was removed. The defense then negotiated with the Commonwealth to dismiss the case upon the woman’s payment of $200 in court costs. The money was paid, and the case was dismissed that same day.
