Criminal Charges:
Man charged in Fall River District Court, Bristol County, Massachusetts for:
- Violation of an Abuse Prevention Order, in violation of M.G.L. c. 209A, § 7
Case Overview:
A woman filed for an abuse prevention order against her cousin in Fall River District Court. In her affidavit, she alleged that he sexually assaulted her on several occasions, continuously harassed her, and that these behaviors related to his ongoing drinking problem. After the hearing, the Court issued the order against him for one year. Approximately one month later, the woman received a missed call from her cousin’s number on her cell phone. The woman reported this to police. Because the man allegedly attempted to contact her in violation of the order, he was criminally charged with Violation of an Abuse Prevention Order in Fall River District Court. The man, who had a history of similar domestic criminal behavior, contacted Massachusetts Criminal Defense Attorney, John L. Calcagni III, to defend him in this matter.
Case Result: Dismissed.
Attorney Calcagni and his legal team conducted extensive legal research into the issues presented in the case, and ultimately, scheduled the case for trial. The day before trial, the Defense successfully secured the Commonwealth’s agreement to dismiss the case.
