Charged in the Uxbridge District Court for Multiple Motor Vehicle Offenses

John L. Calcagni III

Criminal Charges:

A man in Sutton MA was charged in Worcester County in the Uxbridge District Court for:

  • Obstructing a Stationary Emergency Vehicle in violation of M.G.L. c. 89, § 7C;
  • Marked Lanes Violation in violation of M.G.L. c. 89, § 4A; and
  • Speeding in violation of M.G.L. c. 90, § 17.

Case Overview:

A man was driving northbound on Route 146 through the town of Sutton, Massachusetts above the posted 50 MPH speed limit. As he passed a police cruiser monitoring traffic, the man swerved into the breakdown lane over the fog line almost hitting the officer. This resulted in a traffic stop. The officer approached the man and informed him that he almost killed him. The officer issued him a traffic citation for Obstructing a Stationary Emergency Vehicle, Marked Lanes Violation, and Speeding. The man, who already had a negative driving history in Massachusetts, contacted the Law Office of John L. Calcagni III to represent him at a Clerk Magistrate’s hearing.

Case Result:

In preparation for this event, Calcagni and his team conducted its own investigation and put together a packet of information for the Clerk-Magistrate’s consideration. The officer appeared for the hearing and confirmed the above allegations. Following oral argument by Calcagni’s team in support of the man’s defense, the Clerk-Magistrate found the man not responsible for all civil infractions. This result prevented any further negative driving history on the man’s record and successfully averted the possibility of license suspension by the Massachusetts Registry of Motor Vehicles (RMV).
