Case Overview:
Police were dispatched following the report of a domestic incident. Upon arrival to the incident location, police spoke to a woman who informed them that her ex-boyfriend moved out of the residence approximately two months ago but refused to return the keys. Furthermore, that night, without invitation, he entered the apartment to retrieve some belongings, during which time she locked herself in the bathroom with their child to avoid any confrontation. The ex-boyfriend instigated a fight through the bathroom door and tried to force his way inside. The eventually succeeded, almost hitting the woman with the door, and damaging both the door and its frame. He then screamed in the woman’s face, placed her in fear that she would be physically assaulted. The woman contacted police when the ex-boyfriend eventually left. In response, the man was charged in Fall River District Court with Assault on a Family / Household Member, Vandalizing Property, and Assault with a Dangerous Weapon (i.e., the door). He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in his case.
Case Result: Dismissed
While this first case was still pending, the ex-boyfriend was also charged in a second case, also in Fall River District Court, with Violating an Abuse Prevention Order that was put in place between him and the ex-girlfriend. The ex-boyfriend again retained Attorney Calcagni office to defend him. After reviewing all the evidence, conducting an investigation on the man’s behalf, and pretrial discussions with the Commonwealth, Attorney Calcagni and his team office successfully secured the dismissal of all charges.
